European Commission Moves to Exclude Retreaded Tyres from EUDR Scope

–

The European Commission has published a Delegated Regulation amending Annex I of the European Union Deforestation Regulation (EUDR), confirming a significant change for the tyre retreading sector by removing retreaded and used tyres from the regulation’s scope.

Positive EUDR Retreading Update

Published on 13 July 2026, the amendment replaces the previous Annex I entry covering “ex 4012 Retreaded or used pneumatic tyres of rubber; solid or cushion tyres, tyre treads and tyre flaps, of rubber” with a much narrower listing covering only “ex 4012 90 30 Tyre treads.”

The change follows extensive consultation by the European Commission and reflects requests from industry stakeholders for a more targeted approach to products covered by the regulation. The Commission’s explanatory memorandum states that the amendments are intended to provide greater legal certainty, simplify the application of the EUDR, and avoid unnecessary administrative costs for operators, traders, and competent authorities.

In a communication to members, BIPAVER said the amendment was in line with its request to exclude retreaded and used tyres from the regulation, arguing that the change removes the principal risk the EUDR posed to the retreading industry.

The amendment does, however, retain tyre treads within the scope of the EUDR, meaning these products will continue to be subject to the regulation’s due diligence requirements where applicable.

The Delegated Regulation is now subject to a two-month scrutiny period by the European Parliament and the Council. During this period, either institution may object to the act, although neither can amend its contents. BIPAVER noted that, given the summer parliamentary recess, it expects the scrutiny period to be extended, potentially delaying the deadline until 13 November 2026.

If no objections are raised, the Delegated Regulation will be published in the Official Journal of the European Union before entering into force.

The amendment represents a significant development for the European retreading sector, which has been seeking clarification on the application of the EUDR to retreaded tyres since the regulation was adopted. While retreaded and used tyres will no longer fall within the regulation’s scope, tyre treads remain covered under the revised Annex I.
