European Court Decision May Repeal Anti-Dumping Tariff

Repeal Anti-Dumping Tariff

In 2018, alongside other legislations, such as India and the USA. The EU imposed an anti-dumping tariff on certain Chinese manufactured tyres, both retreaded and new.

EU Anti-Dumping Tariff on Chinese Tyres May be Removed by 15th July 2022

The ruling specifying the tariffs and companies impacted upon was Implementing Regulation (EU) 2018/163.

These tariffs have been challenged by the China Rubber Industry Association (CRIA), and the China Chamber of Commerce of Metals, Minerals & Chemicals Importers & Exporters (CCCMC). Who argued that the tariffs were discriminatory and counter to World Trade Agreements.

The case was defended by the European Commission and Marangoni Spa.

The European Court, having taken arguments from both sides decided in favour of the complainants, the CRIA and the CCMC.

The Court awarded costs to the complainants from both the European Commission and Marangoni.

However, the Commission and Marangoni have until the 14th July to Appeal the decision. The duties will continue until that point. Without an Appeal, the tariffs will be removed on the 15th of July 2022. However, should the European Commission and Marangoni make an Appeal, the tariffs will continue until that Appeal is resolved. That process could take up to two years.
