EU Commission Publish First Results on Investigation into Anti-Dumping and Anti-Subsidy Ruling

It has previously been reported that the China Rubber Industry Association (CRIA) and the China Chamber of Commerce of Metals, Minerals & Chemicals Importers & Exporters (CCMC) had brought an action against the EU Commission before the European Court of Justice against the legality of the imposition of anti-dumping and anti-subsidy duties on Chinese truck and bus tyres in 2018, which was upheld in some areas on 4 May 2022.

As a result, no import duties were imposed on Chinese truck/bus tyre imports from 9 July 2022, but the imports were registered. In addition, the EU Commission reopened the investigation procedure to determine the duties in order to take into account the ruling of the European Court of Justice.

The EU Commission has now published the first results of its investigations for interested parties.

These foresee again the impose of anti-dumping/anti-subsidy duties, albeit partly at reduced levels.

The currently determined duties range between 21.12€ and 61.76€/tyre, which corresponds to a reduction of between 0 and 51%, depending on the manufacturer/grouping.

There is still a deadline of 23 January 2023 for comments from the affected/interested parties. Should the notified duties be imposed at the end of the investigation procedure (probably in 2-3 months), the tyres imported since 9 July 2022 would be charged accordingly or any differences between the "old" and "new" duties since the imposition of duties in 2018 would be reimbursed.
