activities optimally; consequently, they do the buffing ac- tivity manually and then turn to another or other informal activities for the next required steps, until they obtain the retreaded tyre to sell on the market. These operations sell the rubber obtained from buffing and retreading tyres, with workers and under working conditions that do not meet mi- nimum standards.
RETREADING AND REPAIR CLASSIFIED AS RECOVERY ALTERNATIVE
Given this reality, and in agreement with the Ministry of Envi- ronment, MINAM, it was agreed that companies dedicated to retreading and repair should be classified as companies dedi- cated to the preparation for reuse and consequently be part of the tyre valorisation (recovery) process and the Circular Economy of the tyre. According to the current legislation, this sector should be certified and be part of the inventory of companies or economic activities that together contribute strongly to the recovery of End-of-Use tyres in Peru, and that it makes no sense to ignore their existence at all.
Therefore, in the regulatory proposal prepared by Ms Rojas, retreading was included as a recovery alternative that should be carried out by formal activities, proposing a mechanism for this purpose.
Finally, this was synthesised in the regulation that MINAM issued in 2021, through the Special Regime for the Manage- ment and Handling of End-of-Use tyres (NFU), Supreme De- cree N° 024-2021-MINAM, which states that:
- As a guideline, the activity of retreading and other activi- ties that extend the useful life of tyres should be carried out
under safety and quality conditions suitable for the exercise of the activity.
- To meet the valorisation goals, the conditioning, retreading and repair of end-of-life tyres or other activities that extend the useful life of tyres should be considered. These activities should be carried out as formalised economic activities.
- Municipalities and others should assist in the formalisation and undertaking of those economic activities.
Finally, Ms Rojas added that the implementation of the regu- lation in a mandatory manner will determine its results and the requirements for its application. This, she said, can be addressed during the future regulatory optimisation process.
